1. Who we are and what this Policy covers
BYou Laser is a brand of medical aesthetic clinics. The BYou Laser website, online store and online booking pages (the “Site”) are operated by BYou Franchising LLC and its affiliates (together, “BYou,” “we,” “us”). Each BYou Laser clinic is independently owned and operated by its own legal entity (each a “Clinic”). The Clinic you select at booking or checkout is identified on your confirmation.
This Policy explains how BYou and the Clinics collect, use, share and protect personal information through the Site, online booking, live chat, email, text messages and phone calls. It also explains your privacy choices and rights.
Information that a Clinic collects in person to provide treatment, such as your medical history, consent forms and treatment records, is also covered by any patient privacy notice the Clinic gives you at your visit. If a Clinic gives you a HIPAA Notice of Privacy Practices, that Notice controls how your protected health information is handled by that Clinic.
2. Information we collect
Information you give us. Depending on how you interact with us, this may include:
- Contact and account details: name, email address, phone number, mailing address, date of birth and login credentials.
- Booking and purchase details: the Clinic, services and packages you choose, appointment history, order history and communications preferences.
- Payment information: payments are processed by third-party payment processors. We do not store full payment card numbers on our servers. If you apply for financing, the financing provider collects your application information under its own privacy policy.
- Health and treatment information: medical history, medications, skin type, contraindications, consent forms, treatment notes and before-and-after photographs. This is collected by the Clinic, usually through intake forms and at your visit.
- Communications: messages you send us by live chat, email, text, web forms or social media, and phone calls. Calls may be recorded for quality and training; we will tell you at the start of the call if a call is recorded.
- Checkout information: if you start checkout, the information you enter (such as your email address and the items in your cart) may be saved even if you do not complete your purchase, so we can remind you about it.
- Survey and review responses you choose to provide.
Information collected automatically. When you use the Site we and our service providers collect device and usage information, such as IP address, browser type, device identifiers, pages viewed, referring pages, and the date and time of your visit, using cookies, pixels and similar technologies (see Section 6).
Information from others. We may receive information from the Clinic you visit, financing providers, referral partners, advertising and social media platforms, and people who refer you or buy a gift for you.
3. How we use information
- To provide, book and manage services, packages, memberships and products, and to process payments, refunds and cancellations.
- To assess eligibility for treatment and provide safe, appropriate care (Clinic only).
- To communicate with you about appointments, orders, aftercare and account matters, by email, phone or text.
- To send you a reminder email if you start but do not finish an online purchase. You can unsubscribe from these reminders at any time.
- To send marketing communications where you have agreed to receive them, and to measure and improve our advertising.
- To operate, secure and improve the Site, prevent fraud and maintain quality and consistency across the BYou Laser system.
- To comply with legal, regulatory, licensing and record-keeping obligations, and to establish or defend legal claims.
4. Health information and photographs
We treat health information and photographs as sensitive. In addition to the rest of this Policy:
- We use health information only to assess you for treatment, provide care, operate the Clinic, and meet legal and professional obligations, and as you otherwise authorize.
- We do not use health information to target advertising, and we do not share it with advertising or social media platforms.
- We do not place advertising cookies or pixels on pages or forms where you enter health information, such as medical history or intake forms.
- Before-and-after photographs are part of your treatment record. We will not use your photographs or identifiable information in advertising, social media or any marketing material without your separate, specific written consent, which you may withdraw at any time.
- Where state law requires your consent before we process health information, we will ask for it, for example on your intake form.
5. How we share information
We do not sell personal information for money. We share personal information only as described below:
- With your Clinic: when you book, buy or contact us, your information goes to the Clinic you select (or the Clinic nearest you) so it can serve you.
- Within the BYou Laser system: BYou and its affiliates may access Clinic customer information to operate the Site and shared systems, support Clinics, maintain quality, brand and compliance standards, and handle transfers between locations that you request.
- With service providers: companies that work for us under contracts that limit their use of the information, such as booking and practice-management software, customer communication and messaging platforms, payment processors, hosting and IT providers, email providers, and analytics providers.
- With financing providers: if you choose to apply for financing.
- With advertising partners: through cookies and similar technologies on non-health pages of the Site, as described in Section 6. Under some state laws this may be considered “targeted advertising,” a “sale” or “sharing,” and you can opt out.
- For legal reasons: to comply with law, a subpoena or court order, licensing or regulatory requirements, to protect the rights, safety and property of clients, staff and others, or to enforce our terms.
- In business transfers: if a Clinic or BYou is sold, merged or reorganized, information may transfer to the successor, which will be bound by this Policy for information collected under it.
- With your consent or at your direction.
6. Cookies, pixels and your choices
We and our partners use cookies, pixels and similar technologies to remember your cart and preferences, keep the Site secure, understand how the Site is used, and measure and personalize advertising. You can block or delete cookies through your browser settings; if you do, some features may not work, but you can still place orders.
Opting out of targeted advertising. You can opt out of targeted advertising and any “sale” or “sharing” of personal information through the “Your Privacy Choices” link on the Site. We also treat a Global Privacy Control (GPC) signal from your browser as a valid opt-out request for that browser. We do not currently respond to other “Do Not Track” browser signals.
7. Text messages
If you give us your mobile number and agree to receive texts, we and your Clinic may send you text messages about appointments, orders and account matters and, if you separately opt in, marketing messages. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help at any time. Consent to marketing texts is not a condition of any purchase.
Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except service providers that help us deliver messages.
8. Marketing emails
If you join our mailing list or buy from us, we may send you emails about our services and offers. Every marketing email includes an unsubscribe link and our physical mailing address, and we honor unsubscribe requests promptly. You will still receive transactional emails about your appointments and orders.
If you enter your email address at checkout but do not complete your purchase, we may send you up to three reminder emails about your cart. These reminders include an unsubscribe link, do not include health information beyond the name of the service in your cart, and are never sent by text message unless you have agreed to receive marketing texts.
9. Your privacy rights
Depending on the state you live in, and subject to legal exceptions, you may have the right to:
- confirm whether we process your personal information and access a copy of it;
- correct inaccurate personal information;
- delete personal information you provided or that we hold about you;
- receive your information in a portable format;
- opt out of targeted advertising, the sale of personal information, and profiling with significant effects; and
- withdraw consent you have given for us to process sensitive data, such as health information.
To make a request, email heretohelp@byoulaserclinic.com or use the request form on the Site. We will verify your identity before responding, and will respond within 45 days (we may extend this by another 45 days where permitted, and will tell you if we do). You may use an authorized agent where state law allows. If we deny your request, you may appeal by replying to our decision; if we deny your appeal, you may contact your state attorney general. We will not discriminate against you for exercising these rights.
Some information cannot be deleted because the Clinic must keep treatment records under state medical records laws. You can request access to and a copy of your treatment records from your Clinic as provided by the law of the state where it is located.
10. How we protect information
We use reasonable administrative, technical and physical safeguards designed to protect personal information, including encryption of data in transit, access controls that limit access to staff and service providers who need it, and confidentiality obligations. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
If a security incident affects your personal information, we will notify you and any required regulators as required by the law of your state.
11. How long we keep information
We keep personal information for as long as needed for the purposes in this Policy, including to provide services, meet legal, tax, accounting and medical records retention requirements, resolve disputes and enforce agreements. Treatment records are kept for the period required by the law of the state where the Clinic is located. When information is no longer needed, we delete or de-identify it.
12. Children
The Site is not directed to children under 13, and we do not knowingly collect personal information online from children under 13. Online purchases are limited to adults 18 and older. Treatment of a minor requires a parent or legal guardian to attend and consent in person at the Clinic. If you believe a child under 13 has given us personal information online, contact us and we will delete it.
13. Third-party websites
The Site may link to third-party websites and services, such as financing providers and social media platforms, that have their own privacy policies. We are not responsible for their practices, and we encourage you to review their policies.
14. Changes to this Policy
We may update this Policy from time to time. We will post the updated Policy on the Site with a new “Last updated” date and, if the changes are material, give you additional notice, such as by email or a notice on the Site. If a change would allow us to use health information in a materially different way, we will ask for your consent where the law requires it.
